These Social Media Terms and Conditions (“Terms”) govern your access to, viewing of, following of, and interaction with any official social media account, page, channel, profile, community, feed, or similar digital presence operated or controlled by Mariwall International Private Limited (“Mariwall,” “Company,” “we,” “us,” or “our”).
By accessing, viewing, following, posting to, commenting on, messaging, tagging, mentioning, sharing, or otherwise engaging with any of our official social media platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you should not engage with our social media platforms.
These Terms supplement our other applicable legal notices, including our Terms of Use and Global Privacy Policy. To the extent of any direct conflict relating specifically to engagement with our official social media channels, these Terms will govern.
1. Scope of Application
These Terms apply to all individuals, entities, visitors, followers, subscribers, users, contributors, and other persons who access or interact with any official Company-operated or Company-controlled social media presence, including any associated content, communications, features, functionality, and services made available through such platforms.
For purposes of these Terms, “Platforms” means any official social media page, account, profile, channel, community, podcast feed, blog, video page, forum, or similar online presence operated by or on behalf of the Company.
2. Public Nature of Social Media Platforms
The Platforms are public or semi-public digital environments.
You should not submit, post, upload, transmit, disclose, or otherwise share through the Platforms any:
a. confidential, proprietary, restricted, or non-public information;
b. personal data that you do not wish to make public;
c. passwords, access credentials, identity numbers, financial information, or sensitive personal information; or
d. project, technical, commercial, contractual, or business information that is not intended for public disclosure.
Your engagement with the Platforms does not amend, replace, expand, or waive any separate agreement, contract, policy, or obligation that may exist between you and the Company.
3. Acceptable Use and User Conduct
You agree that you will not post, publish, transmit, submit, link to, or otherwise share any content through or in connection with the Platforms that:
a. violates any applicable law, regulation, court order, or third-party right;
b. is false, misleading, fraudulent, deceptive, or materially inaccurate;
c. is defamatory, abusive, threatening, harassing, discriminatory, hateful, obscene, or otherwise objectionable;
d. promotes violence, illegal conduct, unsafe practices, or harmful activity;
e. impersonates the Company or any other person or entity, or misrepresents any affiliation, endorsement, or authority;
f. contains unsolicited promotions, chain communications, spam, commercial solicitations, or unauthorized advertising;
g. introduces malware, malicious code, phishing content, corrupted files, or other harmful material; or
h. interferes with the security, integrity, availability, operation, or intended use of any Platform.
We reserve the right, but not the obligation, to remove, restrict, report, hide, moderate, or refuse any content or user interaction, and to block or limit access to the Platforms, at our sole discretion and without prior notice where permitted by applicable law.
4. User Submissions
Any comments, messages, posts, replies, reviews, feedback, suggestions, photographs, videos, audio, tags, mentions, or other materials submitted, posted, or shared by you through or in connection with the Platforms are referred to in these Terms as “Submissions.”
You remain responsible for your Submissions and for the consequences of posting or sharing them.
By making any Submission through or in connection with the Platforms, you represent and warrant that:
a. you own, control, or otherwise have all rights, permissions, consents, and authority necessary to submit the Submission;
b. the Submission does not infringe, misappropriate, or otherwise violate any intellectual property, privacy, publicity, confidentiality, contractual, or other rights of any person or entity; and
c. the Submission complies with these Terms and all applicable laws and regulations.
5. License to Use Submissions
To the extent permitted by applicable law, by submitting or publishing any Submission through or in connection with the Platforms, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, adapt, modify, publish, distribute, display, communicate, and otherwise use that Submission in connection with the Company’s business, communications, informational, archival, educational, promotional, and brand-related purposes.
Where relevant and lawful, this may include the right to use your publicly displayed name, username, profile name, likeness, statements, or associated identifiers as part of or in connection with the Submission.
This license will continue for so long as reasonably necessary for the purposes described above, subject to applicable law and platform functionality.
6. No Obligation to Monitor; No Endorsement
The Company is under no obligation to monitor, screen, verify, moderate, or pre-approve any content appearing on the Platforms. However, we may review, remove, preserve, disclose, or take other action with respect to content where we consider it appropriate, necessary, or advisable.
References to third-party content, links, comments, reposts, reactions, follows, or user-generated content do not constitute endorsement, verification, sponsorship, approval, or adoption by the Company.
Statements made by employees, contractors, or other individuals in personal capacities do not necessarily represent the views of the Company unless expressly identified as official Company communications.
7. Informational Nature of Content
Content made available through the Platforms is provided for general informational, communication, and engagement purposes only.
Unless expressly stated otherwise in a formal written communication issued by the Company, nothing made available through the Platforms constitutes:
a. legal, regulatory, tax, accounting, financial, investment, engineering, technical, or other professional advice;
b. an offer, solicitation, commitment, guarantee, warranty, or binding representation;
c. a confirmation of product availability, specifications, timelines, business terms, or future performance; or
d. an official Company statement for contractual, compliance, or reliance purposes.
You are solely responsible for evaluating any information obtained from the Platforms and for any reliance you choose to place on it.
8. Platform Availability and Third-Party Services
The Platforms may be hosted, operated, or supported by third-party social media providers over which the Company has no control. Your use of those third-party services may also be subject to additional platform-specific terms, privacy notices, community standards, and technical limitations.
We do not guarantee that the Platforms will be available at all times, remain uninterrupted, be error-free, or remain suitable for any particular purpose.
9. Promotions, Surveys, and Campaigns
From time to time, the Company may conduct promotions, campaigns, surveys, contests, or similar activities through the Platforms.
Any such activity may be subject to separate terms, eligibility requirements, disclosures, or official rules. In the event of any inconsistency between those specific rules and these Terms, the specific rules for that activity will govern solely with respect to that activity.
10. Privacy and Data Protection
Any personal data processed by the Company in connection with the Platforms will be handled in accordance with the Company’s Global Privacy Policy and applicable data protection and privacy laws.
You acknowledge that information you choose to post publicly on social media may become accessible to others and may be copied, shared, indexed, archived, or used by third parties. You are solely responsible for ensuring that any information you disclose is appropriate for public sharing and lawful in the jurisdiction from which you access or use the Platforms.
11. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Platforms and all related content are provided on an “as is,” “as available,” and “with all faults” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
Without limitation, the Company disclaims all warranties relating to accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, security, or uninterrupted operation.
12. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other losses, damages, liabilities, costs, or expenses arising out of or relating to:
a. your access to or use of, or inability to access or use, the Platforms;
b. any content posted on, obtained through, or removed from the Platforms;
c. any reliance placed on content made available through the Platforms;
d. any third-party platform act, omission, outage, failure, security issue, or policy change; or
e. any unauthorized access to or use of submissions, communications, or data.
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.
13. Global Application
These Terms are intended to apply globally, subject to applicable local law. Access to or use of the Platforms from any jurisdiction where such access or use would be unlawful is prohibited.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable under applicable law, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.
14. Changes to These Terms
We may revise, update, amend, or modify these Terms at any time in our sole discretion. Any changes will become effective when posted, unless a different date is stated.
Your continued access to or engagement with the Platforms following the posting of updated Terms constitutes your acceptance of the revised Terms.
